The AWPA Stainless Committee members recently participated in sunset reviews of the
outstanding antidumping orders against stainless rod imports from Brazil, France, India
and Spain. Among the actions taken by the committee members were testifying at the
International Trade Commission (ITC) hearing, addressing questions by the
Commissioners; and submitting a written statement after the hearing.
Cheryl Coelho, Vice President and Product Manager at ECD, Inc., and Kimberly
Korbel, AWPA Executive Director made the case before the ITC in favor of eliminating
standing duty orders against these products. Ms. Coelho stated in her opening remarks,
"Revocation of these duties will not result in continued or recurring material injury, and
duties should be lifted to ensure access to world markets for domestic wire producers."
Unfortunately, the commissioners voted against the wire companies. In the antidumping
case against France, the vote was 3:3, with Hillman, Miller and Bragg voting for the
continuation of the orders; Koplan, Okun and Askey voting against. The antidumping
orders against Brazil and India received a 5:1 vote, with only Askey voting against.
Finally, the counter-vailing duty order against Spain was allowed to expire, with the
petitioners not contesting this decision.
In another trade case, a coalition of domestic rebar mills filed a series of anti-dumping
petitions against rebars from Austria, Belarus, China, Indonesia, Japan, Korea, Latvia,
Moldova, Poland, Russian, Ukraine and Venezuela. The ITC must make its preliminary
injury determination by August 14. If the Commission makes a negative determination of
no injury or threat of injury, then the investigation will be terminated. If the Commission
makes an affirmative determination, then the investigation will continue, and the
Department of Commerce will conduct a full-scale investigation to calculate preliminary
dumping margins.
