Legislative Update

Utility Deregulation

The House Commerce Committee is likely to mark up its version of this legislation sometime in April. Efforts are focused on allowing utilities to service customers regardless of geographic location. The Senate is not expected to act on any measure that would implement sweeping reform of the status quo. For its part, the Administration is expected to withhold approval until a compromise includes considerations for its climate change policy.

OSHA Reform

The House may vote this month on two Ballenger sponsored "improvement" bills. These bills would shift resources to consultation programs and prohibit quotas for OSHA inspectors. Senator Enzi of Wyoming is pushing for floor consideration of the SAFE Act. This issue is one which AWPA has followed closely. An updated white paper is being drafted and will be circulated for action with your legislators.

EPA Clean Air - PM 2.5

Senator Inhofe of Oklahoma was able to get Senate approval of an amendment that would clarify the Administration's timetable for particulate matter and ozone rules. The amendment would require three years of data before an area can be classified as "nonattainment". Moratorium bills in both the House and Senate have broad support, but not enough to overcome an expected veto from the President.
