Customs Releases Updated List of Energy and Energy Related Resources

On May 15, U.S. Customs and Border Protection (CBP) released an updated list of “energy and energy resources” – which includes critical minerals – that are subject to the special or fentanyl tariff on Canada but are eligible for the 10% tariff carve-out.

CBP has noted that “Energy and energy resources that qualify for USMCA are not subject to the additional tariffs.”

Canadian products that qualify for USMCA are also exempted from the reciprocal tariffs.  They are not, however, excluded from any applicable Section 232 tariffs or antidumping and countervailing duties.
